 relating to a Freehold estate known as Colliers Farm and Fullwood House situate near Chew Moor in the Township of Lostock in the County of Lancaster with the farmhouse 2 cottages shippon stable and other outbuildings thereon containing including the sites of buildings 29 acres and 24 perches of land statute measure with the mines and minerals thereunder and under certain pieces of land adjoining thereto containing 2 roods 19 perches 25 yards ( the surface of which belongs to the Lancashire & Yorkshire Railway Company ) and which estate was devised by the will of the late Peter Hartley Esquire to his son Peter Pendlebury Hartley

 

10 Feb 1672Indenture of this date made between John Pendlebury of the one part and James Pendlebury and John Leigh the younger of the other part being an underlease of a messuage and tenement situate at Lostock Latche in the occupation of Henry Collier containing 11 acres ( except 2 closes) for a term of 80 years if certain persons should so long live
12 Aug 1673Indenture of this date made between Jeremy Collier the said James Pendlebury and John Leigh the younger of one part and the said John Pendlebury of the other part being an assignment to the said John Pendlebury of the premises comprised in the last scheduled indenture
13 Aug 1685

Counterpart Indenture of this date made between the Honourable Sir Rowland Belasyse of the one part and John Pendlebury of the other part being a lease of the said premises containing 11 acres for a term of 99 years if certain persons should so long live

Extract from list of holdings in Lostock of the Belayse family, which could be the lease of Colliers Farm in 1685:

Messuage, farm, garden, orchard and curtilage let by Sir Rowland Belayse to John Pendlebury for lives of Roger his son, Jane wife of John Derbyshire and John son of Robert Rigby, at 6s. Rent, a boon hen, and a day shearing at Moss Hall when called on: consideration £8.

Indentures of Lease and Release of these respective dates the latter made between John Pendlebury of Lostock of the 1st part  Gerard Pendlebury of the 2nd part John Pendlebury of Over Hulton Peter Pendlebury and Thomas Pendlebury of the 3rd part Peter Hartley and Catherine his wife  John Baron and Alice his wife  Thomas Preston and Betty his wife  Margaret Pendlebury  Ann Pendlebury  and Ellen Pendlebury of the 4th part and James Hartley of the 5th part being a conveyance of 2 messuages and tenements called Colliers Farm and Fullwood House with cottages barn shippons stable and other outbuildings gardens and orchard and several closes of land called the Potato Croft the Nan Collier Croft the Top Moss the Lower Moss the Marled Field the Middle Field the Horse Field the Rushy Field the Collier Meadow the Barn Croft and Fullwood House croft and two plots of Common or waste land (part of Chew Moor) the whole containing 13 acres and 3 roods of large Cheshire measure  And a pew or seat in the North Gallery of Westhaughton Chapel to the persons following (namely)

                        1/6th to dower uses in favour of Peter Hartley

                        1/6th to dower uses in favour of John Baron

                        1/6th to dower uses in favour of  Thomas Preston

                        1/6th each to Margaret, Ann and Ellen Pendlebury

Subject as to the waste lands to the clauses and conditions in the award underwhich same were allotted

2 Jul7 1830Indenture of this date made between the said Peter Hartley of the 1st part the said James Hartley of the 2nd part and the said Ellen Pendlebury of the 3rd part being a mortgage by the said Peter Hartley of his 1/6th share of the said hereditaments to the said Ellen Pendlebury for 1000 years
25 Mar 1845Notice (in duplicate) signed by Peter Hartley of Manchester Corn Merchant declaring his option to purchase the above 1/6th share comprised in the Will of his father the said Peter Hartley and mentioned in the Will of his Mother the said Catherine Hartley
