Henry Pendlebury (1747 - 1828)

Henry Pendlebury was born in 1747 in Blackrod near Westhoughton. He was the sixth son and ninth child of Ralph Pendlebury and Margaret Leyland. Although his father inherited Whittles Farm in Westhoughton, it does not appear that the family were living there at the time of Henry's birth, rather that by this time his father was working as a Cotton Seller in Blackrod (most likely on the families behalf) and his Uncle Gerard has assumed operation of the property

Then in 1755, when he was 8 years old, his father passed away. In March 1758, following the death of his uncles - two years later in 1757 the family inherited a fifth of the proceeds of the sale of the families estates. His brother Roger and Gerard acted on the families behalf in the transfer of the estate to his uncle Gerard Pendlebury. The family are noted as still living in Blackrod at that time.

Indentures of Lease and Release of these respective dates the latter made between Ann Hindley  Mary Pendlebury  Roger Pendlebury and Gerard Pendlebury of Blackroad of the one part and Gerard Pendlebury of Lostock of the other part being a conveyance of the shares of the parties of the 1st part in a messuage and land called the Croft the two Marled Closes the Collier Meadow the New Marled the Moss and the 3 Crofts containing 11 acres to the said Gerard Pendlebury

On 2 Feb 1773 he married Mary Higson at the Deane parish church - St Mary the Virgin - in Rumworth. Mary was the daughter of Giles Higson and Sarah Lythgoe

Henry and Mary had 8 children (seven boys and one girl) all of whom lived to adulthood

In the Deeds and Writings for the property there is the following notation on 20 October 1729, which appears to be the pay out of shares in Whittles to the younger children of Ralph Pendlebury - John, Robert, Henry and Jane (however the date on this must be wrong as none of the children mentioned were born in 1729 AND Jane Pendlebury - Ralphs youngest daughter did not marry William Grundy until 1775 at the very latest), so it would make sense if this date was actually 1779, 

Indenture of this date made between John Robert and Henry Pendlebury and Jean Grundy of the one part and Gerard Pendlebury of the other part being a feoffment of certain shares of the said premises to the said Gerard Pendlebury

There are multiple references to Henry in papers as held by the National Archives, including:

  • No Date (1710 - 1788) - Abstract of title: Henry Pendlebury of Over Hulton, yeoman - Common Close in Westhoughton
  • 6 Mar 1788 - Will of Giles Higson of Over Hulton, fustian manufacturer
  • 24 June 1799 - Land Tax Redemption Certificate: Henry Pendlebury - for property in Westhoughton (See Land Tax Redemption Records above)
  • 28 May 1804 -  Letter: Land Tax Sale Office, Liverpool, to Henry Pendlebury, Westhoughton - registration of Land Tax contract
  • 1805 -  Letter: Land Tax Sale Office, Liverpool, to Henry Pendlebury, Westhoughton - registration of Land Tax contract
  • 4 April 1812 - Agreement: Joshua Coleby, agent for Reverend John Clowes, and Henry Pendlebury - sale of tithes due from property in Westhoughton, for £7.6.3. 4 Apr 1812 ; Attached: Receipt pursuant to above. 12 Nov 1812.
  • In 1813 - Deed to make a Tenant to the Precipe: (i) William Hulton, (ii) Edward Gorst of Preston, gent, & John Gorst of Preston, gent. & (iii) Henry Hulton of Preston, esq. & William Cross of Preston, esq. (he is noted as a tenant of a messuages in Over Hulton)

The Common Close in Westhouhton was owned by the Green family back to the mid 1700s

We do know that the family was living in Over Hulton in 1792 when - at the death of Mary's father - they inherited the Round Thorn farm, however it does appear that the family were living from at least 1773 as this is their registered abode on the baptism records of all of their children. 

He died on 8 February 1828 and was buried at St Mary's the Virgin in Rumworth Deane on 14 February 1828 and his burial was presided over by the then curate F S Baker

His will passed probate in June 1828.
